A man who repeatedly exposed himself after a night out has had his sentencing delayed as the judge did not believe he had showed remorse and she asked for probation reports to be prepared.

Callum Cummins-Wall, 24, pleaded guilty to the charge of disorderly in Guernsey's Magistrate Court yesterday, but the judge said he had been lucky to have had this fairly minor wording as the charge because exposing himself in public in the manner he did, could have seen him charged with something more serious.

The court heard how at around 02:50 on 22 July 2018 Cummins-Wall was seen walking from the taxi rank up St Julians Avenue pushing his trousers to the ground and exposing his penis. As he was in a public place police officers offered him some words of wisdom to stop this behaviour.

Cummins-Wall continued to walk around and then to the taxi rank at the Weighbridge where there were over twenty people and once again walked round showing his penis with his trousers to the ground. He was again warned by police officers that if he continued to expose himself he would be arrested. He did continue to push his trousers down and walk round showing himself and therefore he was subsequently arrested.

When he was interviewed in custody the following day he said he could not remember doing it and then when he was shown the CCTV he said that it was all banter and that the police were wasting time and money looking into this as he could not see what was wrong with his behaviour.

In his defence the court heard that he had a clear police record for three years having previously had disorderly matters and that he was sorry for his behaviour as he sees it as pure stupitity.

At this point the judge interjected as she stated she did not see that he was remorseful and pointed out that he had been warned on a number of occasions not to expose his penis and that the police were only trying to do their job. She continued to state that what made it worse was that when he was intervened the next day after waking up in a cell he was not remorseful and he tackled the police about their ability to do their job.

Judge McMillan said that she was not prepared to deal with this matter today as he had wanted with just a warning: "I think he is at risk from the effects of alcohol and I am loath to accept he has any remorse. I think he is very sorry he got caught and everything he has worked for over the last three years is at risk."

She continued to tell him that the charge of disorderly was very fair by the police: "They could have charged him with something more serious. Why should people on a night out have to put up with someone exposing himself?."

She ordered a full probation report stating : "On a superficial level it is the action of a prankster but actually it was a persistent and contemptuous disregard. I want to know what is going on in your life that you drank so much to do this. He is at risk of a serious sentence and I want to test his remorse."

Cummins-Wall was bailed to appear later next month for sentencing and was given the bail condition not to drink and to submit to a breath test if required to by police.
