The Learning Report at the centre of the ongoing row over safeguarding concerns in local paediatric care is likely to remain under lock and key until the end of this month, and possibly longer.

Express has a copy of the report, but the Committee for Health and Social Care, which commissioned it has said it is not to be published.

The report - written by Sue Walters - was commissioned in 2021 following a number of complaints made over the use of safeguarding processes.

The island's most senior doctor - the Responsible Officer - Dr Peter Rabey commissioned the report but it has never been published.

The existence of the report was highlighted when Deputy Gavin St Pier tried to force the States to debate it last April. He named a clinician during the speech and last month he was cleared of abusing his parliamentary privilege in doing so.

In a speech to the States while noting the decision of the panel which cleared him, he called on HSC to release the report.

"...no families are named, and it would take very little redaction to remove the very small risk that any individual child could be identified. Furthermore, all the families had repeatedly requested that the report be published, and the author had also consented to publication......Why were they so keen to decline publication of this report?" - Deputy St Pier, September 2023

HSC has previously explained that as a learning report, it is a working document for the professionals and families concerned in the situation and it was never intended to be released publicly. HSC has always said it has no intention of releasing the report for a number of reasons including that it is paramount to protect the confidentiality of the children involved.

Express has asked when the report will be published, and if not, why not. It's understood that the Committee will discuss it when its President, Deputy Al Brouard returns from holiday.

While the report has not been published HSC has previously confirmed that it has been "shared and discussed with the families and their concerns investigated and acted upon".

The report raised a number of questions and made a number of recommendations for HSC, the MSG, Primary Care and the Islands Safeguarding Children Partnership.

A representative of the families has been involved in monitoring the work to meet those recommendations since then.

One of those families shared a redacted copy of the report with Express.

A separate statement issued to Express last month, written by some of the families who made the complaints over safeguarding processes, confirmed that "in the case of all of the families, they were wholly exonerated and the authorities acknowledged no concern other than the fact they were caring for chronically sick children".
