A 54-year-old has been sentenced to six months in prison after he breached an existing Sexual Offences Prevention Order by accessing the internet without the prior approval of his Probation Officer.

Ian Gordon Robert Falla was found to have repeatedly accessed the internet between April 25 2021 and January 28 2022 by the High Tech Crime Unit, despite being subject to a five year Prevention Order which was made by Guernsey’s Royal Court on February 25 2021.

Facebook messages had been sent, and the site had been logged into “over 100 times”, according to Crown Advocate Fiona Russell. 

Online searches for “Ian Falla”, “CT Plus”, and “pedos in Guernsey” were also unlawfully instigated by the defendant.  

Falla had previously been convicted of possessing a stash of indecent images of children.

Defending Falla, Advocate Chris Green said Falla accepted he accessed the internet, and agreed with the suggested frequency of log ins. 

The breaches amounted to “madness and stupidity” on Falla’s part but Advocate Green stressed that he was not soliciting indecent images. 

However, Magistrate’s Court Judge Graeme McKerrell thought some of the correspondence did not represent “innocent conversation”.

One instance was where Falla claimed he was still being “naughty”. Judge McKerrell said: “We all know what that means”.  

Advocate Green highlighted the “great support” Falla provides to his elderly parents, as he asked for a community service order to be imposed.

He noted that probation did not recommend extending the Prevention Order but recognised their power to do so before it's culmination if appropriate.

Judge McKerrell said Falla is “becoming a serial offender”, which was of considerable concern to both him and probation services. 

He also said some of the messages had been sent to people considered to be friends by Falla.

“These are not friends, they are perverts of the highest order,” added Judge McKerrell. 

“You have not learned your lesson, and I’m far from conviced you ever will.”

Falla was sent to Les Nicolles for six months.
