A 35-year-old man who broke into and stole 18 boxes of prescription drugs from Queen's Road pharmacy has been sentenced to two-years and three-months in prison by Guernsey’s Royal Court.

Jamie Lee Hutchinson was found to have taken nine boxes of the benzos Levothyroxine, five boxes of Lorazepam and four boxes of Zopiclone - all Class C with an estimated street value of between £350 and £1,400.

Crown Advocate Fiona Russell told the court how in the late evening of 24 October 2022 a witness was on the top floor of their property neighbouring the pharmacy when they heard a “continuous banging” for around 20-minutes. 

The witness’s dog then began to bark and, after looking outside, they could see a silhouette of a person holding an object outside the glass doors of the pharmacy, attempting to break it, she added.  

The police were called and the alarm for the building went off. Hutchinson was seen walking away and scaling a wall into a neighbouring properties’ garden using a torch. 

Officers arrived just before 23:00 and saw a light from a mobile phone and reflective trainers in the garden. Hutchinson then ran towards and leaped over the wall breaking his ankle in the process. Police found him injured and hiding in foliage with boxes of medication falling out of his half-closed jacket. 

More boxes were found in the garden and pharmacy car park. A pair of black gloves with a blood splatter were found inside the building, as well as a green shovel by the door. 

Hutchinson later explained to police that he and his partner had been having a hard time, he had been upset, and was looking for pain relief. But he later denied CCTV of the event was him and denied all knowledge of the other articles of evidence. 

He also noted he had previously been dependant on hard drugs and pain relief medication but had detoxed after a stint in custody.  

Advocate Russell requested compensation to the tune of £2,329.35 for repairs to the pharmacy door, as well as the forfeiture of drugs and evidence.

Hutchinson’s long list of previous convictions includes burglary, theft, and criminal damage.

He was also hauled before the central London Magistrate’s Court in August 2022 for attempted theft and other charges, but he failed to appear for a hearing in October after being bailed. The Metropolitan Police issued a warrant for his arrest which is still outstanding. 

Advocate Sam Maindonald, defending, highlighted her clients’ early guilty pleas and that the last relevant offence had been in 2015, but accepted his poor previous character. 

She labelled the burglary a “not sophisticated or well-planned act” that was aimed at getting medication for his partner. Advocate Maindonald pointed out that Hutchinson had ignored other available drugs, such as opiates, while inside.   

She also noted a “full and frank” letter Hutchinson had written to the court explaining his "stupid act” and requested a suspended sentence or community service as a direct alternative to custody.  

Lt-Bailiff Russell Finch said “burglary is a serious offence” and relied on the “overwhelming DNA evidence. 

Hutchinson’s “very high risk of reoffending” had to be considered as well as the fact he had been in trouble since he was 15, he added. 

“You are a persistent offender... the island deserves some respite from your activity,” Lt-Bailiff Finch said, bemoaning the effect of drug-related offences. 

Hutchinson's prison sentence starts from 20 February 2023, when he was first remanded in custody.  

Petty Debts was deemed a more appropriate avenue for the pharmacy to recover costs for the damage. 

He had been subject to a two-year probation order at the time of the arrest for the burglary, which he had breached earlier in 2022 by not attending meetings with officers. 

Sitting as a judge of the Magistrate’s Court, Lt-Bailiff Finch added a further three-months to his sentence, bringing it to a total of 30-months in prison.
