Seven months for drug possession

Sunday 04 October 2020

A young man who was caught with Class A and B drugs has been sentenced to seven months in prison.

Zak Dragun, 21, was out in his car near Bunker Hill on the evening of 23 May when he was stopped by police.

His car was searched by officers, who found a blag back containing drug paraphernalia, including scales and cash.

Whilst patting him down, the officers noticed a small lump in his clothing and he was taken into custody for a strip search.

Two tinfoil packages were found in his boxers, containing a total of 86.8g of Class B cannabis resin.

Shortly after, the Prosecution said Dragun's address was searched and police found a further 0.082g, along with around 5g of Class A MDMA and three Class B Methylphenidate tablets.

Dragun was ordered to appear in court for the drugs charges, along with a separate offence for breaching an existing probation order by failing to attend one of his meetings.

Defence Advocate Sam Steel said Dragun "struggled to face up to his responsibilities" and was "realistic" about the outcome of the hearing.

He said the drugs were for personal use only to treat the defendant's anxiety and stress.

"Mr Dragun's life was chaotic, unstable and depressing at the time of the offences," Advocate Steel told the Court. "He was smoking a substantial amount."

"This is a young man, who it's reasonable to assume, will mature as time passes."

However, Judge Graeme McKerrell concluded the defendant was making "little effort" to help himself.

"The main report from the Probation Service is one of the most depressing I've read for a while, especially for someone so young," he told Dragun.

"Eyebrows have to be raised when a person is out and about in a car with 86g of cannabis about them as well as a significant amount of cash and scales."

Dragun was given three months for the MDMA, another three months for the cannabis resin and one month for breaching his probation order, making a total of seven months imprisonment.
