Controversial plans to modernise Guernsey's abortion law remain open for public consultation with the Committee for Health and Social Care saying it wants to raise awareness of its proposals before the matter is debated by States members later this year.

The topic would have already been debated by the States, except the covid-19 pandemic has pushed back everything deemed non-essential at this time.

The suggested ways of modernising the 1997 law were first released in March, with plans for a public presentation at the end of that month followed by the States debate before the election which had been scheduled for this month.

As the corona virus crisis took precedence, the presentation and States debate were postponed, with a later attempt by Policy and Resources to push the debate back even further criticised by Deputy Emilie McSwiggan, who said "Guernsey women deserve better".

As social distancing is still being recommended, it is unlikely that a public presentation on the proposals to modernise the abortion law can be held, but HSC acknowledges many people will want to comment on the policy letter before the States decide to change the law or not.

The full proposals, including supporting information, can be read HERE but includes:-

  • Removing the requirement for two medical practitioners to certify an abortion;

  • Increasing Guernsey's gestational limits in line with those in England;

  • Removing criminal sanctions relating to a woman in respect of ending, or attempting to end, her own pregnancy;

  • Allowing early medical abortion procedures to be completed at the woman’s home.

HSC said these proposals have been formed following 'extensive research in respect of best clinical practice, consultation with the professionals involved in abortion- related care in the Bailiwick and discussions with small groups of islanders'.

As an alternative to the public presentation which had been planned HSC wants anyone who has a view on the proposals, or anyone who wants to ask a question, to get in touch by Friday 12 June, via healthandsocialcare@gov.gg or by writing to The Committee for Health & Social Care, Duchess of Kent House, Le Vauquiedor, St Andrew, GY6 8TW.

Once feedback has been collated an anonymous summary will be published ahead of the States debate.

HSC said: "Your responses will also help to identify the need to provide further information in respect of specific areas of the proposals. HSC will keep under review the continued opportunities to raise awareness of the proposals ahead of debate."
