Sark is working with Guernsey to ensure all of its politicians and government staff are fully across new data protection laws which are due to come into force in May.
Sark's Policy & Performance (P&P) and Finance & Resources (F&R) Committees have been working with the States of Guernsey's Home Affairs Committee, the Lead Officer for Data Protection & Information Governance, and the Law Officers of the Crown in developing further data protection legislation.
Chief Pleas approved the Data Protection (Bailiwick of Guernsey) Law, 2017 at the Extraordinary Meeting of Chief Pleas held on 7 December 2017. At the next scheduled meeting, 11 April 2018, Chief Pleas will consider further legislation which has been drafted as follows:
This draft legislation, as above and which can be read in full here, has been considered by P&P as part of the consultation process between the three legislatures and it has given consent to the legislation. The States of Guernsey will approve the legislation and then it will go back before Chief Pleas.
The Data Protection Law of 2017 requires Chief Pleas to have a nominated person to be the Data Protection Officer for the Government and this is subject to ongoing discussions between the Lead Officer and the two Committees with a view to Guernsey providing the Data Protection Officer support remotely.
Guernsey has also offered to conduct training for Conseillers, Officers and Administrative staff with this training being paid for from the existing training budget set by Chief Pleas.
